Vaping Laws in the UAE: The Complete Guide
Vaping is legal in the UAE. It has been since mid-April 2019, when new national standards took effect and replaced an outright prohibition on selling electronic smoking devices. What changed was not that anything goes, but that a product which meets a defined standard may be sold to adults.
That distinction is the whole of the subject when it comes to the vaping laws UAE applies. The vaping laws UAE residents actually encounter are product rules, tax rules and place rules — not a ban. This guide sets out each in turn, with the clause references, and links down to the format-specific pages where the detail differs.
Vaping Laws UAE: The Short Answer
- Legal to buy and use for adults aged 18 and over, since April 2019.
- Governed by UAE.S 5030:2018, the national standard for electronic nicotine products.
- Nicotine in e-liquid is capped at 20mg/ml under clause 4.2.4.
- 100% excise tax, plus a minimum excise price of AED 1 per millilitre on liquids since 1 September 2026.
- Advertising is prohibited, and so is selling to anyone under 18.
How Vaping Became Legal
Before 2019 there were effectively no vaping laws UAE sellers could comply with: the sale of electronic smoking devices was not permitted, though possession and personal use occupied a grey area. Products circulated through informal channels with no standard governing what was in them.
That ended in mid-April 2019, when the standards authority brought a new framework into force legalising the sale and use of electronic smoking devices, aligned with the World Health Organization’s framework convention on tobacco control. Manufacturers, wholesalers and retailers became able to import and sell e-cigarettes, electronic pipes, electronic shisha devices and refill liquids.
The practical effect was to move vaping from unregulated to regulated, which is why the vaping laws UAE shoppers deal with today are mostly about product conformity rather than permission.
What Makes a Vape Legal to Sell
Three things have to be true of a product on a UAE shelf under the vaping laws UAE enforces.
1. It meets UAE.S 5030:2018
This is the national standard for electronic nicotine products and the backbone of the vaping laws UAE applies. Its scope covers two groups: tobacco-free electronic vape products with or without nicotine and their refill packages, and heated tobacco products containing processed or unprocessed tobacco. Combustible products and orally consumed tobacco sit outside it.
So the same standard governs an disposable vape, a refillable kit and a heated tobacco stick, with different clauses applying to each.
2. It is certified and registered
ECAS, the Emirates Conformity Assessment Scheme, is a mandatory certification programme for regulated products. Certificates run for one year and must be renewed annually. Devices and liquids must be registered, and packaging labels must themselves be registered and approved before use.
There is also the Emirates Quality Mark, a conformity mark for products meeting the relevant national, regional or international standards under an effective quality management system.
3. Excise has been paid
Covered in full further down, but under the vaping laws UAE enforces it is a condition of lawful sale rather than an afterthought.
The Product Limits in the Vaping Laws UAE Applies
These are the numbers worth memorising from the vaping laws UAE applies to products, all from UAE.S 5030:2018:
| Limit | Figure | Clause |
|---|---|---|
| Nicotine in electronic liquid | Maximum 20mg/ml | 4.2.4 |
| Integrated tank capacity | Maximum 10ml | 4.2.5 |
| Refill package volume | Maximum 50ml | 4.2.6 |
| Nicotine grade | Pharmaceutical grade | 4.2.2 |
| Filters, paper, capsules | No tobacco, extracts or nicotine | 4.1.13 |
| Additives | No vitamins or stimulants implying benefit | 4.1.11 |
The 20mg/ml figure is the one that matters most to buyers. It is the legal ceiling for nicotine strength in e-liquid sold in the UAE, and it applies to the liquid in a salt nicotine bottle and to the pre-filled liquid in a disposable alike.
Note what it does not cover. Heated tobacco sticks contain no liquid, so clause 4.2 does not reach them, and the standard sets no separate nicotine limit for heated tobacco — the detail is on the heated tobacco legality page.
Labelling and Health Warnings
A compliant pack is recognisable on sight, which makes labelling the easiest check a buyer can run against the vaping laws UAE requires sellers to meet.
| Requirement | Detail | Clause |
|---|---|---|
| Nicotine warning | In Arabic and English | 5.2.8 |
| Warning size | More than 50% of the main display area | 5.2.9.1 |
| Warning placement | English lower front, Arabic lower back | 5.2.9.1 |
| Age restriction | 18+ wording in both languages, plus a symbol of at least 1cm x 1cm | 5.2.10 |
| Liquid hazard sentence | Bilingual | 5.2.11 |
| Visibility | Warning unobscured, including by tax stamps | 5.1.6 |
| Leaflet | Required with each full system package | 5.3 |
If a pack carries no Arabic, or the warning covers a fraction of the face rather than more than half, it was not produced for this market. That is the single most useful test when buying a kit or liquid from any source.
What the Vaping Laws UAE Enforces Prohibit
The vaping laws UAE sellers operate under are stricter on promotion than on the product itself.
- Advertising, promotion and sponsorship of e-cigarettes and tobacco products are prohibited under Federal Law No. 15 of 2009 on tobacco control, including at the point of sale.
- Reduced-risk and therapeutic claims are prohibited under clause 5.1.2, along with misleading descriptors such as “light” or “natural” and claims of economic or lifestyle benefit.
- Sale to anyone under 18 is prohibited, and penalties attach to the seller.
- Vouchers, discounts and two-for-one offers printed on packs or outer packaging are prohibited under clause 4.1.14.
- Text on the outer cellophane wrapper is not permitted under clause 5.1.5.
The claims prohibition is why no retailer in this market, this one included, may describe any nicotine product as safer, healthier or a way to quit. It is not reticence; it is clause 5.1.2.
Tax on Vaping Products
Two separate measures apply under the vaping laws UAE applies to tax, and they are frequently confused.
Excise at 100% applies to tobacco products, to electronic smoking devices and tools, and to the liquids used in them — whether or not those liquids contain nicotine or tobacco. The rates sit in Cabinet Decision No. 52 of 2019 on Excise Goods, Excise Tax Rates and the Methods of Calculating the Excise Price, and are published on the UAE Government excise tax portal.
A minimum excise price of AED 1 per millilitre on liquids used in electronic smoking devices took effect on 1 September 2026. This sets a floor rather than a rate: a 30ml bottle carries at least AED 30 of excise regardless of its pre-tax value.
| Measure | Applies to | Does it reach heated tobacco sticks? |
|---|---|---|
| 100% excise, tobacco products | Processed or unprocessed tobacco | Yes |
| 100% excise, electronic smoking devices | Devices and tools | No |
| 100% excise, liquids | E-liquid, nicotine or not | No |
| AED 1/ml minimum excise price | Liquids for electronic smoking devices | No |
Under the vaping laws UAE applies to tax, excise is built into shelf prices rather than added at checkout, which is why UAE vape pricing looks high against other markets. The effect on stick pricing specifically is worked through on the TEREA price page, and the device-versus-disposable sums are in the pod kit versus disposable comparison.
Where You Can and Cannot Vape
Legal to buy is not the same as permitted everywhere, and the vaping laws UAE applies to places are where most people actually run into trouble.
Federal Law No. 15 of 2009 prohibits smoking in certain enclosed public spaces and on public transport, and those restrictions are generally applied to vaping as well. Beyond the law, individual venues set their own policies — malls, hotels, restaurants, offices and airports each make their own rules, and a building being privately owned does not make it permissive.
The safe assumption under the vaping laws UAE applies indoors is that vaping is not allowed unless something says it is. Mosques, schools, hospitals, government buildings and public transport are firmly out. Vaping while driving is not specifically prohibited but can attract attention if it obstructs your view or control of the vehicle.
Rules That Differ by Format
The general position above covers vaping. Three formats carry their own additions to the vaping laws UAE applies, and each has a dedicated page.
| Format | What differs | Where to read it |
|---|---|---|
| E-liquid and devices | The 20mg/ml and volume caps in clause 4.2 | This page |
| Heated tobacco | No liquid, so no nicotine cap; taxed as tobacco | Heated tobacco legality page |
| Nicotine pouches | A separate standard and conformity route | Pouch legality page |
For heated tobacco, the ILUMA and TEREA range sits under the same standard but different clauses, and the format comparison explains why the nicotine figures are not comparable.
For nicotine pouches, the governing standard is a different one entirely — the position is set out on the pouch legality page, and strengths are mapped in the pouch strength guide.
Who Regulates What
Responsibility is split across three instruments, and knowing which one governs a question saves a lot of confusion.
| Instrument | Governs | Examples |
|---|---|---|
| UAE.S 5030:2018 | The product itself | Nicotine cap, tank size, labelling, warnings, prohibited claims |
| Federal Law No. 15 of 2009 | Tobacco control generally | Advertising prohibition, 18+ sale, public place restrictions |
| Cabinet Decision No. 52 of 2019 | Excise | 100% rate on devices, liquids and tobacco |
Conformity assessment sits alongside those through ECAS and the Emirates Quality Mark. So a product can satisfy the standard on paper and still be unlawful to sell if it is not certified and registered, which is the part importers most often get wrong.
How the Rules Have Changed
| When | What changed |
|---|---|
| Before April 2019 | Sale of electronic smoking devices not permitted; no product standard |
| Mid-April 2019 | National standards take effect; sale and use legalised for compliant products |
| 2019 onward | 100% excise applies to devices and liquids under Cabinet Decision No. 52 of 2019 |
| 1 September 2026 | Minimum excise price of AED 1 per millilitre introduced on liquids |
The direction has been consistent: broaden legal access, tighten the product rules, and raise the tax. Anyone expecting the vaping laws UAE applies to loosen further is reading the trend backwards.
Enforcement and Penalties
Enforcement falls mainly on sellers rather than users. Selling to a person under 18 attracts penalties, and so does selling non-conforming stock — a product without valid certification, or with labelling that was never registered and approved, is not lawfully saleable regardless of what it contains.
For individuals, the realistic exposure is venue rules and public-place restrictions rather than product law. Vaping where it is prohibited can mean being asked to stop, removed, or fined depending on the location and the authority involved.
Customs is the other point of contact. Bringing devices and liquid in for personal use is subject to allowances enforced at the border, and those are applied by customs officers rather than by the product standard, so they can differ from what a retailer here may lawfully sell you.
Common Misconceptions
Four things people get wrong about the vaping laws UAE operates under:
- “Vaping is banned.” It was before April 2019. It is not now, and has not been for years.
- “The 20mg/ml cap applies to everything.” It applies to electronic liquid. Heated tobacco contains no liquid and has no equivalent nicotine cap under the standard.
- “Nicotine-free liquid is untaxed.” The 100% excise applies to liquids used in electronic smoking devices whether or not they contain nicotine or tobacco.
- “If it is sold here it must be compliant.” Not automatically. The checks later on this page exist because non-conforming stock reaches this market.
That last one is the important one, and it is why the vaping laws UAE sets out are worth knowing as a buyer rather than only as a seller.
What This Means When You Buy
Five checks cover almost everything the vaping laws UAE imposes on a pack:
- Arabic and English warning across more than half the pack face.
- An 18+ mark in both languages with the symbol.
- Nicotine stated at 20mg/ml or below on any e-liquid.
- Tank or bottle within the caps — 10ml integrated, 50ml refill.
- No health or quit claims anywhere on the pack or listing.
A product failing those was not built for this market, whatever the seller says. The same checks apply to accessories that contain or contact liquid, and puff-count claims are a separate question covered in the puff count guide.
Frequently Asked Questions
Is vaping legal in the UAE?
Yes. Under the vaping laws UAE brought in, the sale and use of electronic smoking devices has been legal since mid-April 2019, when national standards took effect and replaced a prohibition on sale. Products must meet UAE.S 5030:2018 and may only be sold to adults aged 18 and over.
What is the maximum nicotine strength allowed in the UAE?
The vaping laws UAE applies cap it at 20mg/ml in electronic liquid, under UAE.S 5030:2018 clause 4.2.4. That is the ceiling for both bottled e-liquid and the liquid pre-filled into a disposable.
Are there limits on tank or bottle size?
Yes. An integrated tank may not exceed 10ml under clause 4.2.5, and a refill package may not exceed 50ml under clause 4.2.6.
How much tax is on vaping products in the UAE?
100% excise on electronic smoking devices and on the liquids used in them, whether or not they contain nicotine. Since 1 September 2026 a minimum excise price of AED 1 per millilitre also applies to those liquids. Excise is included in the shelf price.
Can vapes be advertised in the UAE?
No. Under the vaping laws UAE enforces, advertising, promotion and sponsorship of e-cigarettes and tobacco products are prohibited under Federal Law No. 15 of 2009, including at the point of sale. Reduced-risk and therapeutic claims are separately prohibited under clause 5.1.2.
Where is vaping banned in the UAE?
Smoking restrictions on certain enclosed public spaces and public transport are generally applied to vaping too, and individual venues set their own policies. Assume indoor vaping is not permitted unless signage says otherwise.
What age do you have to be to buy a vape in the UAE?
18 under the vaping laws UAE applies. Sale to anyone under 18 is prohibited and packs must carry the restriction in Arabic and English with a symbol of at least 1cm by 1cm, under clause 5.2.10.
How can I tell if a vape is legal for sale in the UAE?
Check the pack: a bilingual Arabic and English nicotine warning covering more than half the main display area, an 18+ mark, nicotine at 20mg/ml or below, and no health or cessation claims. Products lacking those were not produced for this market.
Do the same rules apply to heated tobacco and nicotine pouches?
Partly. Heated tobacco falls under the same standard but different clauses, and the 20mg/ml liquid cap does not apply to it. Nicotine pouches sit under a separate standard with their own conformity route. Both have dedicated pages.
The Short Version
The vaping laws UAE applies make it legal for adults, and have done since April 2019. A legal product meets UAE.S 5030:2018, is certified through ECAS, carries a bilingual warning over more than half the pack, and holds no more than 20mg/ml of nicotine. It carries 100% excise plus a AED 1 per millilitre floor on liquids. Advertising it is prohibited, selling it to under-18s is prohibited, and using it indoors is usually prohibited unless a venue says otherwise.
These products contain nicotine, which is addictive. For sale to adults aged 18 and over only. Not for use by non-smokers, pregnant or nursing women, or people with heart or lung conditions. Nothing on this page is a health claim, and these products are not smoking-cessation treatments. This page is general information about regulation, not legal advice.
